This agreement is between you and TechGPT Ltd only — not Apple, Google or any other store operator. TechGPT Ltd, not the store, is solely responsible for the application and its content.
1. Scope
This End User Licence Agreement ("EULA") governs your use of any mobile or desktop application published by TechGPT Ltd ("the Application"), including all updates, upgrades and supplements, unless a separate licence accompanies a particular update, in which case that licence applies to it.
By downloading, installing or using the Application you accept this EULA. If you do not accept it, do not install or use the Application, and delete it from your device.
This EULA supplements our Terms of Service, which continue to apply. Where the two conflict in relation to app usage, this EULA prevails.
2. Scope of licence
TechGPT Ltd grants you a non-transferable, non-exclusive, revocable licence to use the Application on any device that you own or control, as permitted by the usage rules of the store you obtained it from.
For applications obtained from the Apple App Store, this licence is governed by the Usage Rules set out in the Apple Media Services Terms and Conditions, including the right to use the Application on other Apple-branded devices you own or control, and by anyone else through Family Sharing or volume purchasing where those apply.
The Application is licensed, not sold, to you. TechGPT Ltd retains all right, title and interest in it.
3. Restrictions
You may not:
- Copy the Application except as this EULA permits;
- Modify, adapt, translate or create derivative works from it;
- Reverse engineer, decompile or disassemble it, or attempt to derive its source code, except to the extent that restriction is prohibited by applicable law;
- Rent, lease, lend, sell, redistribute or sublicense it;
- Remove, obscure or alter any proprietary notice;
- Use it on a jailbroken or rooted device, where doing so bypasses the security model the Application relies on;
- Use it in breach of our Acceptable Use Policy or any applicable law.
4. Maintenance and support
TechGPT Ltd is solely responsible for providing maintenance and support for the Application. Apple, Google and other store operators have no obligation whatsoever to furnish any maintenance or support services in relation to it.
Contact us at support@techgptltd.com or through our support centre.
5. Warranty
TechGPT Ltd is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed.
For applications obtained from the Apple App Store: in the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the sole responsibility of TechGPT Ltd.
Except as expressly stated, and to the fullest extent permitted by law, the Application is provided "as is" without warranty of any kind. Nothing in this section affects the statutory rights of consumers, which cannot be excluded or limited.
6. Product claims
TechGPT Ltd, not Apple or any other store operator, is responsible for addressing any claims by you or a third party relating to the Application or your possession and use of it, including but not limited to:
- Product liability claims;
- Any claim that the Application fails to conform to an applicable legal or regulatory requirement;
- Claims arising under consumer protection, privacy or similar legislation, including in connection with the Application's use of a framework such as HealthKit or HomeKit.
This EULA does not limit TechGPT Ltd's liability beyond what applicable law permits.
7. Intellectual property claims
In the event of any third-party claim that the Application or your possession and use of it infringes that third party's intellectual property rights, TechGPT Ltd, and not Apple or any other store operator, will be solely responsible for the investigation, defence, settlement and discharge of that claim.
8. Legal compliance
You represent and warrant that:
- You are not located in a country subject to a United Kingdom, European Union or United States government embargo, or designated as a "terrorist supporting" country;
- You are not listed on any government list of prohibited or restricted parties;
- You will comply with all applicable export control and sanctions laws in using the Application.
9. Third-party beneficiary
Apple and Apple's subsidiaries are third-party beneficiaries of this EULA in relation to applications obtained from the Apple App Store. Upon your acceptance of this EULA, Apple has the right — and is deemed to have accepted the right — to enforce this EULA against you as a third-party beneficiary of it.
10. Third-party terms
You must comply with applicable third-party terms of agreement when using the Application. For example, you must not be in violation of your wireless data service agreement when using it, and you must comply with the terms of any third-party service the Application integrates with.
11. Privacy
Our collection and use of personal data through the Application is described in our Privacy Policy, and summarised in the App Store privacy label and Google Play Data Safety declaration for the specific app. You may delete your account and data at any time — see Delete your account.
12. Purchases and subscriptions
Where the Application offers paid content or subscriptions, they are transacted through the store you obtained the Application from and are subject to that store's terms and refund policies. Subscriptions renew automatically unless cancelled through the store at least 24 hours before the renewal date. See our App Store policies, Google Play policies and Refund Policy.
13. Term and termination
This EULA is effective until terminated. It terminates automatically if you breach any of its terms, and you may terminate it at any time by deleting the Application and all copies of it. On termination you must stop all use of the Application. Sections concerning intellectual property, warranty disclaimers, liability and governing law survive termination.
14. Limitation of liability
To the fullest extent permitted by law, and subject to the exceptions in section 12 of our Terms of Service, TechGPT Ltd's total aggregate liability arising out of or in connection with the Application is limited to the greater of the amount you paid for the Application in the 12 months before the claim, or £100.
Nothing excludes liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded. Consumers' statutory rights are unaffected.
15. Contact and governing law
